Cadac Group Privacy and Cookie Statement

Cookie and privacy statement

Cadac Group BV and all its affiliated companies process personal data on a daily basis via the Cadac website. Cadac Group BV and all its affiliated companies consider the careful handling of personal data to be of great importance. Personal data is, therefore, carefully processed and protected by us. In our processing, we comply with the requirements of the General Data Protection Regulation (GDPR).

In this Privacy and Cookie Statement, we explain what personal data Cadac Group BV and all its affiliates process and for what purpose. We encourage you to read this Privacy and Cookie Statement carefully.

1. Cadac Group BV and all associated companies' data

This Privacy and Cookie Statement has been drawn up by Cadac Group BV, established at Nieuw-Eyckholt 282, 6419DJ Heerlen, registered in the commercial register of the Dutch Chamber of Commerce under number 29039048 (hereinafter referred to as: "Cadac").

Cadac is responsible for the processing and storage of your personal data. If you have any questions about the content of this Privacy and Cookie Statement, you can contact us at any time using the contact form on the service & contact page.

2. Personal data

Cadac processes different types of personal data for different purposes. Below is an explanation of which personal data and purposes these are.

  • Services

In order to be able to provide our services, we need your name and address, e-mail address, telephone number and Dutch Chamber of Commerce number (if available). This way we can process your account request, contact you, provide our services and keep you informed of the process. We also need your payment details. This enables us to receive and pay any payments related to an assignment. If necessary for our services, we provide your personal information to third parties. This includes providing your personal data to (potential) clients for the purpose of obtaining an assignment and banks for the execution of payments.

From freelancers who have submitted a Cadac Experts account request on our website, we ask for additional information for the performance of our services, such as relevant diplomas and certificates. We use this information to check the suitability and quality of service providers. This enhances the professionalism and reliability of our website. This information will only be used internally and will not be passed on to other organisations unless you personally make it visible on your profile.

  • Create account

In order to make purchases in our store, to consult your order history, to retrieve your downloads, to extend your subscription or to book an expert you must create an account on our website. We process this data based on the implementation of our agreement. Therefore, we process following data:

  • Name
  • Address,
  • City
  • Email
  • Password
  • Order history

In order to use a Cadac Experts account, you need to create an account and an expert account on the Cadac website. The expert account allows you to receive assignments and provides a central point to see which assignments you are involved in. Creating an account means that we do not have to ask for your details for each individual assignment. To create an account, we ask for your name, gender, address, place of residence, telephone number, VAT number and e-mail address. We also ask for some additional personal data for the performance of our services, such as relevant diplomas and certificates.  This data is stored in our database.

Until you cancel your account, we continue processing your data. Unless there is a statutory obligation, such as the fiscal retention obligation, that requires longer storage of some data.

  • Video's

It is possible to watch videos on our website. Although the video is played directly on the website, we have saved the video on the professional video platform YouTube. When you watch the video, it automatically connects to YouTube. YouTube may then place cookies on your device that are required to play the video.

  • (Direct) Marketing

In order to provide you with offers that interest you, we collect commercially interesting information about individuals, such as demographic data. We do this by placing cookies. We may collect information about you from third parties, including information from our partners and social media sites in accordance with your settings on such websites.

  • Social media

Cadac can be found on various social media, such as Facebook, LinkedIn, YouTube and Twitter. Cadac uses social media plugins on its website. If you click on one of these buttons and register with your social media account, information is shared with the social media website and may be shown on your profile. In addition, we may use your personal data when you use features on the websites and/or social media apps, such as a "Facebook like". If you use these features, we may obtain your personal data through our respective social media channel.

The Cadac website also includes buttons to promote the web pages of our social media accounts. These buttons work by means of code from the social media platform. As soon as you click on a button, this code places cookies, allowing the social media platform to receive your personal data, for example, your IP address. We refer to the privacy statements of the relevant social media platforms which explain which personal data they collect.

  • Application procedure

Cadac collects and processes applicant data by means of personal contacts, by post, by e-mail and/or telephone calls. We collect data like the applicant's name, gender, contact details, cover letters, information about the applicant's educational level and employment history. This data is relevant to the application process and will be deleted at the latest 4 weeks after the end of the process. With your permission, Cadac can store your personal data in its administration for a longer period of time so that you can be contacted again in the future.

  • Employees

Cadac processes employee personal data within the framework of the employment contract and on the basis of legal principles. For information about the processing of employees' personal data, please refer to the personnel manual.

  • Contact form

You can contact us by filling out our digital contact form. In order to provide you with the best possible service, we ask you to fill in your name, address, postal code, city, e-mail address and your message for us.

3. Recipient

We do not share your personal data with companies, organisations and individuals, except in one of the following circumstances:

  • Implementation of a contract

Communication of your personal data to third parties is permissible if this is necessary to fulfil our contractual obligations towards you. Part of this is placing your profile and collecting and making payments.

  • With your permission

With your permission, we may pass on your personal data to other parties. The permission only applies if it is clear what you are giving your permission for and what the consequences of this are.

  • For external processing

We provide personal data to our partners so that they can process data for us, based on our instructions and in accordance with our privacy policy and other appropriate confidentiality and security measures.

  • For legal reasons

We share personal information if we believe that disclosure of the information is necessary to comply with applicable laws, regulations, legal procedures or requests from government agencies.

  • Legal obligation

If a legal obligation requires us to do so, we will disclose your personal data. For example, it is possible for the police to request information from us as part of a fraud investigation. Another example is that under Article 47 of the Dutch General Tax Act, the tax inspector can claim all the information necessary to levy tax.

Cadac makes arrangements with the recipients of your personal data to ensure that the personal data is treated confidentially and is protected.

4. Retention period

We do not retain your personal data for longer than necessary unless there is a legal obligation for us to retain your personal data for longer. Our basic principle is that we only store personal data for as long as is necessary to be able to provide you with our products and/or services. We will then remove your personal data as far as possible. For example, if you have provided your e-mail address so that we can keep you informed of our services, we will still store your data for that purpose. You can also create an account, as explained in paragraph 2 above. Inactive accounts will be deleted after a period of 2 years. If you have provided your e-mail address (possibly via your account) so that we can keep you informed of our services, we will still store your data for this purpose.

 5. Transmission of personal data outside of the EU

Cadac may transfer your personal data from the Netherlands to other countries. Countries within the European Economic Area (EEA) have an equivalent level of protection of personal data as the Netherlands. With due observance of the general requirements of privacy laws and regulations, we may pass on your personal data. We can do this, for example, within our group for the benefit of good business operations.

Outside the EEA, we will only transfer your personal data if there is an adequate level of protection. Cadac uses sample contracts approved by the European Commission for this purpose. We will pass on your personal data in particular to branches within our group for our internal business operations.

6. Cookie policy

This website uses cookies. Cookies are information files that can be automatically stored on or read from the visitor's device (such as PC, tablet or smartphone) when visiting a website. Cookies are used to collect information about an individual, the website or statistics. Some cookies are also intended to improve the user experience on the website.

 7. Types of cookies

A distinction needs to be made between functional and non-functional cookies. Functional cookies – also known as technical cookies – are always placed by us as they are necessary for the website to work properly and do not process personal data other than for the purpose for which the personal data was entered.

Non-functional cookies process personal data out of your sight. These cookies are not necessary for the functioning of the website, but mainly enable websites to improve their services. As non-functional cookies process personal data outside of the user's view, we always ask for permission before we place these cookies.

Cadac uses the following non-functional cookies:

Analytical cookies

Analytical cookies are used to analyse the use of the website. We can improve the website by collecting statistics about the use of our website.

Tracking cookies

Tracking cookies are placed to identify an internet user on a website. We can track which web pages you visit by placing tracking cookies. We can deduce what your preferences and interests are from the information about your website visits. Based on this, we can make you personalised offers.

Advertising cookies

Advertising cookies are used to display personalised ads and to measure the effectiveness of an advertising campaign. The advertisement cookies are necessary to be able to actually show the advertisements.

Social media cookies

The use of social media cookies enables easy integration of the website with various social media websites (e.g. sharing the website on social media).

When you click on a social media icon, the social networks place cookies on your device. They can then see what you are doing on the internet. Which cookies these social networks place and how long they stay in place depends on the social network you use. We, therefore, recommend that you read the cookie statements of the relevant social network.

  • Cookie settings

When you visit our website for the first time, you will receive a cookie message stating that the website uses cookies. If you agree to this, you give us permission to use all cookies and plugins as described in the cookie message and in this cookie statement.

Blocking cookies

If you do not want us to store information about you and the settings of your devices, you can indicate this in the cookie message that you receive. If you have you accepted our cookies before, then you will no longer see this message and you will have to delete the cookies yourself (if desired).

You can also choose to block the placing of cookies via your internet browser. You can also set your internet browser to notify you when a website uses cookies. Then you can decide each time whether you want to give permission for this. If you would like more information about blocking cookies, please refer to the manual of your internet browser.

Please note that many websites do not work optimally if the cookies are blocked. We recommend that you only selectively block unwanted cookies.

Deleting cookies

8. Your rights

You have a number of legal rights against us: access, correction or addition, data erasure, restriction of processing, transfer of digital data and the right of objection. We explain these rights below. We also explain how you can exercise these rights against us.

  • Right of access

At your request, we will inform you in writing if we process your personal data. When making your request, you must identify yourself by means of a copy of your driving license or identity document. In our response, we will explain what personal data we have processed or are processing about you, and we will give you a copy of it. We also explain the purposes for which the data has been or will be processed, with whom the data will be shared, how long it is expected to be stored, and what other rights you can enforce.

  • Correction or addition

If you have received access to the processing of your personal data, you can ask us to correct any inaccuracies or to supplement any incompleteness. We will justify our response. If we are going to make corrections, you will receive a supplementary statement from us. Any recipients of your incorrect or incomplete data will also receive this statement.

  • Data erasure

You may request that we delete your personal data in our systems in one or more of the following cases:

  • the personal data is no longer needed for the purposes for which we have processed it;
  • you withdraw your consent for (further) processing, and there is no other basis for processing;
  • you make a reasoned objection, and there are no compelling reasons not to honour your objection;
  • the personal data has been unlawfully processed by us;
  • we have to delete your personal data on the basis of a legal obligation;
  • we have collected your data by means of mobile telephony or internet services.

  • Restriction of processing

If you have reported an inaccuracy or incompleteness in your personal data to us, you can ask us to limit the processing as long as we are still busy processing your request. You may also ask us to limit the processing of your data if you believe that we are processing your data unlawfully or no longer need it, or if you have objected to (further) processing of your data. Upon receipt of your request for limitation, we will only process the data after obtaining permission or for important reasons (such as legal proceedings).

  • Transfer of digital data

If you have submitted personal data to us in a structured, customary digital file format, and we have processed your data with your consent or in the performance of a contract with you, you have the right to ask us for a copy of this data. In such cases, you can also ask us to forward your data directly to another service provider.

  • Objection

You may, at any time, object to the processing of personal data relating to you. This applies in particular to profiles that we have created on the basis of your personal data. We will cease processing your data upon receipt of your objection unless we are able to invoke compelling legitimate reasons that outweigh your interests, rights and freedoms.

If we process your personal data for direct marketing purposes, you may object to this at any time and we will immediately cease to process the data.

  • Exercising your rights

If you would like to make use of one or more of the rights listed above, please contact us via e-mail. Cadac will make a decision about your request within 4 weeks unless we let you know within that period that we need a little more time.

If your personal data is processed on the basis of your consent, then you have the right to revoke your consent. Any revocation of your consent will not affect any previous processing based on this consent.

When processing your personal data with cookies, you can also exercise all the rights listed in this article.

9. Liability

Cadac shall not be liable for any technical or editorial errors contained in this website, nor for any consequential damages resulting from the use or temporary unavailability of this website or the links to the websites of third parties.
